The Lokpal Act does provide for the creation of a prosecution wing, headed by the Director of Prosecution, to prosecute public servants. However, it remains non-functional. Until the prosecution wing is constituted, the central government is required to make available officers and staff from its ministries or departments to assist in conducting prosecutions under the Act.

Statement 2 is correct: The inquiry wing of the Lokpal, which has civil court powers, is responsible for conducting preliminary inquiries under the Lokpal and Lokayuktas Act 2013 (Act of 2013). Lokpal chairperson has been authorised to commence the selection process for appointment of specified number of suitable persons as officers and staff required to provide logistical assistance in the inquiry wing.
